How the Process Works Look2Claim has a number of established solicitors on their panel who are ready to assist people like you wanting to make a claim for compensation. Once you have provided Look2Claim with the accident circumstances along with your injuries we will pass these over to one of our panel solicitors. The solicitor will consider the claim on its merits; additionally the solicitor is likely to contact you to confirm a few details with you - it is important that you provide current contact details. Otherwise the solicitor may reject a good claim just because they were unable to contact you. The solicitor will then make a decision as to whether to accept and pursue the claim for you, with your agreement of course, or they may decide to reject the claim. In this instance we at Look2Claim will seek a second opinion on your behalf from another Panel Solicitor. Limitation If the claim is rejected by a solicitor it is important to note that it doesn’t necessarily mean you are unable to pursue your claim for compensation. The legal system is made up of opinions, and one solicitor may reject a claim but another may accept it. However whilst we are on the subject; it is important that you are aware of the ‘Limitation Act’. This piece of legislation puts a limit on the time period you are able to make a claim. If you are over the age of 18 when the accident occurred then you have until the 3rd year anniversary of the accident for a claim to be lodged with the court. However if you were under the age of 18 at the time of the accident, then you will have until your 21st birthday before the claim needs to be lodged with the court. Once you are beyond the above timescales, you are unlikely to be able to pursue the claim as it will be classed as ‘out of time’. Medicals You will need to be medically examined by an independent medical expert. This will be arranged by your solicitor through a Medical Agency. They will always ensure your medical is in close proximity to your home. Once you have had your medical the medical expert will provide a report outlining the injuries you have suffered and the prognosis; how long it will take you to fully recover. Your solicitor will then ensure you are happy with the content of the report and then they will be in a position to ‘value your compensation’ and seek offers and/or negotiate a settlement. Timescales It is always difficult to put a definite timescale on long you it will take for the claim to settle. However on average you could expect the following as a guide: RTA claim 3 – 9 mths EL claim 12 – 36 mths Med Neg 18 – 48 mths ID claim 24 – 48 mths |
